General Terms and Conditions

1. Scope of Application

For the use of this website as well as the business relationships between Sea House (hereinafter referred to as "Sea House") and its customers, the following General Terms and Conditions (GTC) apply in the version currently available and valid at the time the website is accessed or goods are ordered.
The offers made by Sea House are intended for customers residing or having a delivery address within the postal code regions served by Sea House in Switzerland.

2. Products and Prices

Sea House products include fresh and frozen seafood as well as fish. As these are natural products, slight variations in weight may occur.
All prices are quoted in Swiss Francs (CHF) and include the statutory value-added tax (VAT). Shipping and delivery costs, if applicable, are listed separately. Sea House reserves the right to change prices at any time.

3. Conclusion of Contract, Purchasing Process, and Delivery Area

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. By clicking the "Buy" / "Place Binding Order" button, the customer submits a binding order and purchase offer for the seafood items contained in the shopping cart.
The contract is finalized as soon as Sea House confirms the order via email and the online payment process is successfully completed.

Wichtig: Der Kunde ist verpflichtet, vor der Bestellung über die Funktion «Liefergebiet prüfen» die Verfügbarkeit der Lieferung an seine Postleitzahl zu validieren. Bestellungen ausserhalb des Liefergebiets können nicht ausgeführt werden.

4. Delivery and Handover (Freshness Guarantee)

Sea House delivers twice a week across Switzerland:

Orders placed by Tuesday evening will be delivered on Mittwoch geliefert.

Orders placed by Friday evening will be delivered on Samstag geliefert.

Since these are highly perishable foods, it must be ensured that the goods can be received in person on the delivery day or that a suitable, protected location is available for drop-off (e.g., in front of the front door). Upon handover or drop-off of the goods, the responsibility for maintaining the cold chain shifts to the customer.

5. Terms of Payment and Online Payment

The purchase price for the ordered goods is due immediately upon placing the order in the online shop. The customer can choose from the electronic online payment methods offered during the checkout process (e.g., TWINT, credit cards such as Visa/Mastercard, or PostFinance).
The preparation and delivery of the order will only take place after successful authorization of the payment by the respective payment provider. Delivery on account or cash payment upon delivery is excluded.

6. Right of Withdrawal and Returns

Since the products offered by Sea House are rapidly perishable foods, the statutory right of withdrawal under Swiss law is excluded. Returns of goods due to a change of mind or personal dislike are not possible.

7. Notification of Defects and Warranty

The customer is obliged to inspect the delivered goods immediately upon receipt for quality and completeness. Any defects (e.g., damaged packaging, interruption of the cold chain prior to handover) must be reported to Sea House immediately, at the latest within 24 hours of delivery, via email (info@seahouse.ch) with supporting photographic documentation. In the case of justified complaints, a credit note or a replacement delivery will be issued.

8. Liability

Sea House is only liable for damages resulting from intentional or grossly negligent breaches of contract. Liability for slight negligence as well as for indirect or consequential damages (e.g., incorrect storage by the customer) is excluded.

9. Applicable Law and Jurisdiction

Swiss law applies exclusively. Subject to mandatory statutory provisions, the place of jurisdiction is the registered office of Sea House (Oftringen, Switzerland).
